General Terms and Conditions (GTC)

§ 1 Scope

These General Terms and Conditions (GTC) apply to all orders placed through the online shop moigene.com (operated by Genja Badalyan Cosm Lab). The version valid at the time of the contract conclusion is decisive.

§ 2 Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order. By submitting the order, the customer makes a binding offer. Acceptance occurs through an order confirmation via email or by shipping the goods.

§ 3 Prices and Payment

All prices are gross prices including the statutory value-added tax of 19%. The following payment methods are offered:

• Credit Card (Shopify Payments)
• PayPal
• Apple Pay
• Klarna

Payment is due immediately after the order is placed.

§ 4 Shipping and Delivery

We deliver to the following countries: Germany, Austria, and other EU countries.

Shipping costs:

• Germany: €4.90
• Austria: €6.90
• Rest of EU: as determined during the order process

For orders over €50.00, shipping within Germany is free.

Delivery times:

• Germany: approx. 2–4 business days
• Austria & EU: approx. 3–7 business days

After dispatch, the customer will receive an email with tracking information.

§ 5 Right of Withdrawal and Return

Consumers generally have a statutory right of withdrawal of 14 days.

Exclusion of the right of withdrawal for cosmetic products:
According to § 312g para. 2 no. 3 BGB (German Civil Code), the right of withdrawal does not apply to sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. For hygienic reasons, opened or used cosmetic products are therefore excluded from exchange and return.

Unopened and unused products can be returned within the statutory withdrawal period. Returns are at the buyer's expense. The refund will be made after receipt of goods using the original payment method.

§ 6 Retention of Title

The goods remain the property of Genja Badalyan Cosm Lab until full payment.

§ 7 Warranty

The statutory warranty rights apply. The warranty period is two years from the delivery of the goods.

§ 8 Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
